Drivers under 21 who fail a BAC test can have their license suspended for 180 days whereas a refusal results in one-year suspension. An underage driver who fails a chemical test can obtain specialized driving privileges during the suspension, but a driver who refused a chemical test may not do so. While the penalties for impaired driving or a BAC of .08 or above carries the same criminal penalties for drivers under 21 as adult drivers, underage drivers will be charged with a Class C infraction for driving with a BAC of at least .02 but less than .08.
